The A&W Cup Crew Contest

Official Rules

NO PURCHASE OR PAYMENT NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. ELIGIBILITY

The A&W High Low Contest (the “Contest”) is open only to legal residents of Canada who have reached the legal age of majority in their province/territory of residence at the time of entry. Employees, franchisees, representatives and agents of Coca-Cola Ltd., A & W Food Services of Canada Inc. (“A&W” and collectively with Coca-Cola Ltd., the “Sponsors”), Coca-Cola Canada Bottling Limited, Launchfire Interactive, Inc. (“Administrator”), or any of their respective parent companies, affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production execution or distribution of the Contest (collectively, the “Contest Parties”) and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (people who share the same residence at least three (3) months out of the year) of each such employee, franchisee, representative or agent are not eligible. The Contest is subject to all applicable federal, provincial, territorial and municipal laws and regulations and these Official Rules are subject to change without notice in order to comply with such laws and regulations. Void where prohibited. Participation constitutes entrant’s full and unconditional agreement to be legally bound by these Official Rules and Sponsors’ decisions, which are final and binding in all matters related to the Contest. Winning a Prize is contingent upon fulfilling all requirements set forth herein.

2. CONTEST PERIOD

The Contest begins on May 16, 2022 at 12:00 a.m. Eastern Time (“ET”) and ends on September 18, 2022 at 11:59 p.m. ET (the “Contest Period”). The Contest Period consists of the following entry periods (each, an “Entry Period”):

3. HOW TO PARTICIPATE

(a) Registration

NO PURCHASE NECESSARY. To participate, you must register for the Contest. To register for the Contest, you must visit www.cupcrewcontest.ca (the “Contest Website”) during the Contest Period and follow the on-screen instructions to complete the registration process, which will require you to: (i) provide your first name, last name, email address, and postal code; (ii) create a password for the purposes of subsequent participation in the Contest; and (iii) signify that you have read and agree to be legally bound by the terms and conditions of these Official Rules (a “Registration”). All information provided must be complete and true. To be eligible, your Registration must be fully completed, submitted, and received in accordance with these Official Rules during the Contest Period.

Limit of one (1) Registration per person and per email address during the Contest Period. Disposable email addresses cannot be used for Registration. Multiple participants are not permitted to share the same email address. For certainty, you only need to register one (1) time in this Contest, and you may only register once for the Contest.

(b) Obtain Game Plays

The Contest includes an online multiple-choice game (the "Game") that takes place on the Contest Website (see below for details). In order to play the Game, you will first need to receive Game plays (each, a "Game Play"). After completing and submitting your Registration in compliance with these Official Rules (as determined by the Sponsors at their sole discretion), you will automatically receive three (3) Game Plays through the Contest Website. You can receive additional Game Plays through the various options set forth below, during the Contest Period, by following the on-screen instructions available on the Contest Website following Registration:

  • Signing Up to Receive Emails from A&W: You will receive five (5) Game Plays if you sign up to receive email communications from A&W through the Contest Website during the Contest Period. You may only receive such Game Plays by opting-in once for the Contest (maximum five (5) Game Plays per person via this method), and you may later withdraw your opt-in consent for A&W to use your personal information to send promotional emails at any time without losing your Game Plays (for details on how to withdraw your consent, please consult the A&W Privacy Policy, which is available at https://web.aw.ca/en/privacy). This section does not limit any other consent(s) that an individual may provide A&W or others in relation to the collection, use and/or disclosure of their personal information.
  • Submitting a Story: You will receive three (3) Game Plays if you submit a unique and original story (maximum 256 characters) explaining How are you committed to reducing your environmental impact? (a “Story”) through the Contest Website during the Contest Period. You may only submit one (1) story (maximum three (3) Game Plays per person via this method). To be eligible, all content and materials associated with your Story must be in accordance with these Official Rules, including, but not limited to, the specific Submission Requirements listed below. By submitting a Story, you hereby: (i) grant to the Sponsors, in perpetuity, a worldwide, exclusive, license to publish, display, reproduce, modify, edit, make available, communicate to the public by telecommunication and otherwise use your Story (and each component thereof), in whole or in part, for advertising or promoting the Contest or for any other reason in any type of media; (ii) waive all moral rights in and to your Story (and each component thereof) in favour of the Sponsors (and anyone authorized by the Sponsor to use such Story); and (iii) agree to release and hold harmless the Released Parties from and against any and all claims, damages, liabilities, costs, and expenses arising from use of your Story (or any component thereof), including, without limitation, any claim based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related or other cause of action whatsoever.
  • Entering Code Words: You will receive three (3) Game Plays for each unique code word you enter via the “Enter Code Words” section of the Contest Website during the Contest Period. Code words will be released on the contest sit and in A&W emails during the Contest Period (all as determined by the Sponsors in their sole and absolute discretion). You may only enter any unique code word once and you may only earn a maximum of twenty-four (24) Game Plays during the Contest Period pursuant to this method.
  • Sharing with Friends: You will receive one (1) Game Play for each friend who registers for the Contest for the first time in compliance with these Official Rules (as determined by the Sponsors at their sole discretion), in accordance with any of the two (2) methods outlined below. You may only earn a maximum of ten (10) Game Plays during the Contest Period pursuant to this method. IMPORTANT NOTE: You may only share with individuals who are (a) friends with whom you have had direct voluntary two way communications, and with whom it is reasonable to conclude that you have a personal relationship considering shared interests, experiences, opinions and other relevant factors, or (b) family members to whom you are related by marriage, a common-law partnership, or parent-child relationship, and with whom you have had direct voluntary two way communications. You are solely responsible for ensuring you only share Contest-related information in compliance with applicable anti-spam laws in Canada (and you agree to indemnify and hold harmless the Released Parties (defined below) with respect to any claim to the contrary).
    • Personal Link or Banner: A unique “Quick Link” will be displayed on the “Share with Friends” section of the Contest Website when logged in, which you can copy to share during the Contest Period. You may wish to post your link on instant messenger, blogs, message boards and personal web pages or in emails (subject to compliance with the applicable platform’s terms of service and applicable anti-spam laws in Canada). The distribution of your personal web link is at your discretion, subject to the following: Sponsors reserve the right, in their sole discretion, to cancel and void any personal web link (and all associated earned Game Plays) which they deem, in their sole and absolute discretion, to be used or associated with content that is inappropriate. Without limiting the foregoing, such content includes all forms of pornography, spam, inappropriate language and content that incites hate, is demeaning, depreciates the value of the Sponsors’ name(s), brand(s), products or trade-marks, or incites discrimination of in any form.
    • Social Media - Twitter: To invite friends via Twitter, if you are a user registered through Twitter, login to the Contest Website, click on the Twitter icon in the “Social” portion of the “Share with Friends” section of the Contest Website and perform the following three required steps during the Contest Period: (i) click to post the predefined message that is provided by Sponsors to your Twitter home page; (ii) enter your Twitter username; and (iii) press the “Tweet” button. PRIVACY NOTE: No personal information will be collected by the Sponsors or the Administrator from Twitter.

Each Game Play obtained per this section of the Rules can only be used once when playing the Game, as outlined below. A used Game Play expires immediately upon use.

Limit of forty-five (45) Game Plays (and corresponding Game Iterations, defined below) per entrant, per email address during the Contest Period, regardless of the method of entry. Any attempt by any participant to obtain more than the stated number of Game Plays by using multiple/different email addresses, identities, Registrations and logins, or any other methods will void that participant’s Game Plays (and corresponding Entries, as applicable) and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification.

Submission Requirements: By participating in the Contest, you agree that all submitted content and materials associated with your receipt of a Game Play (including, without limitation, a Story) (collectively, “Game Play Materials”) comply with all conditions stated in these Official Rules. The Released Parties will bear no liability whatsoever regarding the use of your Game Play Materials and any use, collection, storage and disclosure of any personal information. The Released Parties shall be held harmless by you in the event it is discovered that you have departed from or not otherwise fully complied with any of these Official Rules. This release and indemnity shall continue in force following the termination of the Contest and/or awarding of any prizes. By participating in the Contest, each entrant hereby warrants and represents that any Game Play Materials (including, without limitation, a Story) he/she submits:

  • i. does not contain images or likenesses of brands or products which are competitors of the Sponsors;
  • ii. is/are original to him/her and that the entrant has obtained all necessary rights in and to the Entry Materials for the purposes of entering such Entry Materials in the Contest;
  • iii. does not violate any law, statute, ordinance or regulation;
  • iv. does not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence;
  • v. will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party; and
  • vi. is/are not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following: nudity; alcohol/drug consumption or smoking; explicit or graphic sexual activity, or sexual innuendo; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups; that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct; personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic); commercial messages, comparisons or solicitations for products or services other than products of Sponsors; any identifiable third party products, trade-marks, brands and/or logos, other than those of Sponsors; conduct or other activities in violation of these Official Rules; and/or any other materials that are or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsors in their sole and absolute discretion.

The Sponsors, Administrator and/or designated content moderator (the “Reviewer”) reserves the right to screen all Game Play Materials. Any Game Play Materials that the Reviewer deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Official Rules are subject to disqualification. The Reviewer reserves the right, in its sole and absolute discretion at any time and for any reason, to remove any Game Play Materials (or any part thereof) and/or to request an entrant to modify, edit and/or re-submit his or her Game Play Materials (or any part thereof) in order to ensure that the Game Play Materials comply with these Official Rules, or for any other reason. If such an action is necessary at any point during or after the Contest, then the Sponsors reserve the right, in its sole discretion, to take whatever action it deems necessary based on the circumstances – including, without limitation, disqualifying the Game Play Materials (and therefore the corresponding Game Plays and/or the associated entrant) – to help ensure that the Contest is being conducted in accordance with the letter and spirit of these Official Rules.

(c) Play the Game

Once you have completed your Registration and received Game Plays for the Contest, login to the Contest Website during the Contest Period and follow the on-screen instructions to use one (1) Game Play to begin an iteration of the Game (each, a “Game Iteration”). Once you have started a Game Iteration, you will be asked a series of quiz questions (each, a “Question”) each with only two (2) answer options presented on screen, a correct answer option (a “Correct Answer”) or an incorrect answer option (an “Incorrect Answer”). During each Game Iteration, you will earn one (1) Contest entry (each, an “Entry”) for each consecutive Correct Answer that you select for a Question, until (i) you choose to end the Game Iteration, or (ii) you select an Incorrect Answer to a Question, in which case the Game Iteration will end and you will not earn an Entry for the Incorrect Answer and will also forfeit all accumulated Entries you earned during that same Game Iteration regardless of the number of Correct Answers you received.

During a Game Iteration, you may also receive bonus Entries in connection with an uninterrupted series of Correct Answers as follows: if you select ten (10) Correct Answers in a row, you will receive five (5) bonus Entries.

You may earn up to a maximum of 60 Entries.

IMPORTANT NOTE: JUST BECAUSE A GAME SCORE, BASED ON THE CORRESPONDING NUMBER OF ENTRIES RECEIVED, MAY APPEAR ON A CONTEST LEADERBOARD OR OTHERWISE DOES NOT MEAN THAT THE PARTICIPANT ASSOCIATED WITH THAT SCORE IS OR WILL BE A WINNER. ANY SUCH PUBLIC DISPLAY OF SCORES IS FOR ENTERTAINMENT PURPOSES ONLY. WINNERS WILL BE DETERMINED IN ACCORDANCE WITH THE PROCEDURES SET OUT BELOW. ONLY THE SPONSORS CAN DEEM A PARTICIPANT TO BE A WINNER. ANY OR ALL SCORES AND CORRESPONDING ENTRIES MAY BE VERIFIED BY THE SPONSORS IN THEIR SOLE AND ABSOLUTE DISCRETION AT ANY TIME AND FOR ANY REASON.

Any attempt by any participant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, Registrations and logins, or any other methods will void that participant’s Entries and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Sponsors are not responsible for lost, late, incomplete, invalid, unintelligible or misdirected Registrations, Game Plays, Game Iterations, Correct Answers, Incorrect Answers, Entries (collectively “Contest-Related Information”) or other Contest participation, all of which will be disqualified. In the event of a dispute as to the individual associated with a Registration and/or Game Iteration, the authorized account holder of the email address used will be deemed to be the registrant or player. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. Administrator’s computer is the official time keeping device for this Contest.

4. PRIZES

Secondary Prizes

There are four (4) secondary prizes available to be won (each, a “Secondary Prize”) as of the start of the Contest Period. The number of Secondary Prizes available will decrease as they are claimed in accordance with these Official Rules. Each Secondary Prize consists of one (1) electric scooter, with an approximate retail value (“ARV”) of $1,099.99 CAD.

Grand Prize

There is one (1) grand prize available to be won (the “Grand Prize”). The Grand Prize consists of four (4) electric bikes, with a total ARV of $8,359.96 CAD.

The following terms and conditions apply to each Secondary Prize and the Grand Prize (each, a “Prize” and collectively, the “Prizes”): (i) Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by the Sponsors in their sole and absolute discretion); (ii) no substitutions are permitted, except at the Sponsors’ option; (iii) the Sponsors reserve the right to substitute a Prize in whole or in part in the event that all or any component of such Prize is unavailable with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsors’ sole discretion, a cash award; (iv) all characteristics and features of the Prizes, except as otherwise explicitly stated above, are at the Sponsor’s sole and absolute discretion; (v) Prize winner is solely responsible for all costs not expressly described herein; (vi) winner is responsible for all taxes and fees associated with Prize receipt and/or use; (vii) Prize will be awarded only if the potential Prize winner fully complies with these Official Rules; (viii) manufacturer’s standard warranty, if any, applies to the Prize; (ix) Prize winner is solely responsible for reading and following all instructions, directions for use and warnings that are associated with the applicable Prize; and (x) Prize winner is solely responsible for confirming and following all requirements to legally operate the applicable Prize in his/her jurisdiction of residence. None of the Released Parties (defined below) makes any representation or offers any warranty, express or implied, as to the quality or fitness of any Prize awarded in connection with the Contest. To the fullest extent permitted by applicable law, each confirmed winner understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsors or any of the other Released Parties should his/her Prize fail to be fit for its purpose or is in any way unsatisfactory. For greater certainty and the avoidance of any doubt, by accepting a Prize, a confirmed winner agrees to waive all recourse against the Sponsors and all of the other Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part.

Limit one (1) Prize per person.

5. WINNER SELECTION

NO ONE IS A WINNER UNLESS AND UNTIL THE SPONSORS OFFICIALLY CONFIRM HIM/HER AS A WINNER IN ACCORDANCE WITH THESE OFFICIAL RULES. BEFORE BEING DECLARED A CONFIRMED WINNER, each potential winner is subject to the Sponsors’ verification of his/her eligibility and compliance with these Official Rules (including without limitation, compliance with all Prize claim procedures set out below).

Secondary Prizes

On each of the draw dates listed in the following table at approximately 12:00 p.m. ET in Ottawa, Ontario the Administrator will perform a random draw to select one (1) Entry from amongst all eligible Entries received in accordance with these Official Rules prior to the close of the corresponding Entry Period (and, for greater certainty, all unselected Entries in a random draw will carry over into any subsequent random draw(s)), as determined by the Sponsors at their sole discretion. The odds of winning a Secondary Prize depend on the number of eligible Entries received prior to the close of the applicable Entry Period.

In the event a potential Secondary Prize winner is disqualified for failing to comply with these Official Rules, as determined by the Sponsors at their sole discretion, the Sponsors reserve the right in their sole discretion, to select an alternate eligible entrant through a random draw from among the remaining applicable eligible Entries received in accordance with these Official Rules prior to the close of the applicable Entry Period (as determined by the Sponsors at their sole discretion).

Grand Prizes

On September 20, 2022 at approximately 1:00 p.m. ET in Ottawa, Ontario the Administrator will perform a random draw to select one (1) Entry from amongst all eligible Entries received in accordance with these Official Rules during the Contest Period to select the Grand Prize winner. The odds of winning the Grand Prize depend on the number of eligible Entries submitted and received in accordance with these Official Rules during the Contest Period.

In the event that the potential Grand Prize winner is disqualified for failing to comply with these Official Rules, as determined by the Sponsors at their sole discretion, the Sponsors reserve the right in their sole discretion, to select an alternate eligible entrant through a random draw from among the remaining eligible Entries received in accordance with these Official Rules prior to the close of the Contest Period (as determined by the Sponsors at their sole discretion).

6. WINNER NOTIFICATION AND CONFIRMATION

The potential Prize winners will be contacted using the email address provided with their Registration (as determined in Sponsors’ discretion) approximately one (1) day after the applicable draw date. Failure by an entrant to respond to the initial verification contact within forty-eight (48) hours of notification or return of e-mail notification as undeliverable after three (3) attempts may, in Sponsors’ sole discretion, result in disqualification (and potential winner will forfeit all rights to the applicable Prize) and Administrator or Sponsors may select an alternate winner in the same manner as set out above (and the foregoing requirements will apply to the newly selected potential winner).

Before being declared a confirmed winner, each potential Prize winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsors, be administered online, by telephone, by email, in the Sponsors’ declaration and release or other means); and (b) sign and return within two (2) business days of notification the Sponsors’ declaration and release form, which (among other things): (i) confirms compliance with these Official Rules; (ii) acknowledges acceptance of the applicable Prize (as awarded); (iii) releases the Released Parties from any and all liability in connection with this Contest, the potential Prize winner’s participation therein and/or the awarding and use/misuse of the applicable Prize or any portion thereof; (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsors in any manner or medium whatsoever, including print, broadcast or the internet, worldwide and in perpetuity; and (v) confirms winner’s full mailing address for delivery of their Prize by courier. A&W Food Services will arrange to ship the Prizes to the respective winners’ mailing addresses provided within two weeks of receipt of the completed declaration and release form.

If any potential Prize winner incorrectly answers the skill-testing question, is found to be ineligible, if he or she has not complied with these Official Rules (including without limitation, fails to return the Sponsors’ declaration and release form within the specified time, as applicable), or declines a Prize for any reason prior to award (all as determined in the Sponsors’ sole and absolute discretion), such winner will be disqualified (and will forfeit all rights to the applicable Prize). By accepting a Prize, each winner hereby: (i) confirms that he/she has read, understood and is in compliance with these Official Rules; (ii) accepts the applicable Prize as awarded; and (iii) releases the Released Parties from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the applicable Prize or any portion thereof, and agrees to indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities arising out of or relating to the winner’s participation in the Contest and/or his/her acceptance, use or misuse of the Prize.

ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSORS OR ADMINISTRATOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. SPONSORS WILL NOT ACCEPT SCREENSHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY CONTEST-RELATED INFORMATION SUBMITTED AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED DEFECTIVE AND IS VOID AND WILL NOT BE HONORED. No more than the stated number of Prizes will be awarded. In the event that production, seeding, printing, digital or programming failures, or other reasons or any errors cause more than the indicated number of Prizes to be available and/or claimed in connection with the Contest, Sponsors reserve the right to award only the number of Prizes allocated to the Contest as per these Official Rules.

7. VERIFICATION

All Contest-Related Information and entrants are subject to verification at any time and for any reason. The Sponsors reserve the right, in their sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsors – including, without limitation, government issued photo identification): (i) for the purposes of verifying an entrant’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Contest-Related Information and/or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsors deems necessary, in their sole and absolute discretion, for the purposes of administering this Contest in accordance with the letter and spirit of these Official Rules. Failure to provide such proof to the complete satisfaction of the Sponsors within the timeline specified by the Sponsors may result in disqualification in the sole and absolute discretion of the Sponsor. The potential Prize winners must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements.

8. ENTRY CONDITIONS AND RELEASE

By entering, each entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of Sponsors and Administrator; (b) release and hold harmless the Contest Parties and all of their respective past and present officers, directors, employees, agents, successors, assigns and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, Contest-Related Information, participation in the Contest, acceptance or use or misuse of a Prize; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorney’s fees) arising out of or relating to an entrant’s participation in the Contest and/or entrant’s acceptance, use or misuse of a Prize.

9. PUBLICITY

Except where prohibited, participation in the Contest constitutes each winner’s consent to Sponsors’ and their agents use of winner’s name, likeness, photograph, voice, opinions and/or hometown and province/territory for Contest purposes in any media, worldwide in perpetuity, without further payment or consideration.

10. GENERAL CONDITIONS

In the event that the operation, security, disease, pandemic or other related situation, or administration of the Contest is impaired in any way for any reason, including, but, not limited to, fraud, virus or other technical problem, the Sponsors may, in their sole discretion, either (subject only, when legally required, to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec): (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b) cancel the Contest and award the Prizes up to the date of cancellation in accordance with the applicable procedure above (and any remaining Prizes that have not been awarded will not be awarded). The Sponsors reserve the right in their sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or the Contest Website or to be acting in violation of the Official Rules of this or any other promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsors reserve the right to seek damages from any such person to the fullest extent permitted by law. The Sponsors’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If the Contest, or any part of it, is discontinued for any reason, Sponsors, in their sole discretion, may elect to hold a random drawing from among all eligible Entries received up to the date of discontinuance for any Prize offered herein. No more than the stated number of Prizes will be awarded.

In the event of any conflict or inconsistency between the English version of these Official Rules or other statements contained in any Contest-related materials, including the Contest Website, the French version of these Official Rules, and/or print or online advertising; the English version of these Official Rules shall prevail, govern and control. Standard data rates apply to participants who choose to participate in the Contest via a mobile device. Code words obtained through unauthorized sources or which are incomplete, mutilated, altered, reproduced, forged, counterfeited or irregular in any way, are automatically void. The Sponsors are not responsible for any lost code words. Code words are the property and intellectual property of the Sponsors, and may not be used for any other promotional, commercial or other purposes without the authorization of the Sponsors.

11. LIMITATIONS OF LIABILITY

Except where prohibited, by participating in the Contest, entrants agree to release and hold harmless the Released Parties from and against any claim or cause of action arising out of participation in the Contest or the Contest Website or receipt or use/misuse of any Prize, including, but not limited to: (a) unauthorized human intervention in the Contest or the Contest Website; (b) technical errors related to computers, servers, providers, printers or telephone or network lines; (c) printing errors; (d) errors in the administration of the Contest or the Contest Website or the processing of entries; (e) late, lost, or undeliverable mail; (f) any defect in a Prize or inability to participate in the Contest or use the Contest Website or use/misuse of a Prize, or (g) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest receipt, acceptance, delivery, possession, use or misuse of any Prize. Each entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest and in no event shall the Released Parties be liable for legal fees. Entrants waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. If, for any reason, an entrant’s Entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another Entry, if it is possible in the Sponsor’s or the Administrator’s sole discretion.

12. DISPUTES

To the maximum extent permitted pursuant to applicable law, each entrant agrees that: (a) all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants, Sponsors or any of the other the Released Parties in connection with the Contest will be governed by and construed in accordance with the domestic laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws; (b) the parties hereby consent to the exclusive jurisdiction and venue of the courts located in Ontario in any action to enforce (or otherwise relating to) these Official Rules or relating to the Contest; and (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys' fees.

FOR QUEBEC RESIDENTS ONLY: Notwithstanding the foregoing, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

13. ENTRANT INFORMATION

By entering this Contest, each entrant expressly consents to the Sponsors, Administrator, and each of their respective agents and/or representatives, storing, sharing and using the personal information submitted only for the purpose of administering the Contest and in accordance with Coca-Cola Ltd.’s Privacy Policy which is available at https://www.coca-cola.ca/policies/privacy-policy, A&W Food Services of Canada Inc.’s Privacy Policy which is available at https://web.aw.ca/en/privacy, and Launchfire Interactive, Inc.’s Privacy Policy which is available at https://www.launchfire.com/privacy, as applicable. This section does not limit any other consent(s) that an individual may provide the Sponsors or others in relation to the collection, use and/or disclosure of their personal information.
